General Terms and Conditions

1. Scope and provider

These terms apply to all orders placed via the online shop of
Mbake – Inhaber: Marko Zink, Am Judenfriedhof 9, 56743 Mendig, Telefon +49 175 6671452, E-Mail info@m-bake.de.

A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person who, when concluding the contract, acts in the exercise of their trade, business or profession.

2. Conclusion of contract

The display of items in the shop does not constitute a binding offer but an invitation to order. By submitting the order via the “Order subject to payment” button, you make a binding offer. We confirm receipt of your order without delay by email; this acknowledgement of receipt does not yet constitute acceptance. The contract is concluded once we declare acceptance or dispatch the goods.

3. Prices

All prices are final prices and include statutory VAT. Additional shipping costs as stated under item 4 apply.

4. Shipping and delivery time

For shipping within Germany we charge a flat fee of 6,90 € per order. The delivery time is usually 2–5 Werktage from conclusion of the contract. We will inform you promptly of any deviations. For deliveries outside Germany, please contact us in advance.

5. Payment

Payment is made by invoice. Online payment is not offered. The invoice amount is due without deduction within 14 days of the invoice date, unless otherwise agreed.

6. Retention of title

The delivered goods remain our property until paid in full.

7. Right of withdrawal

Consumers have a statutory right of withdrawal. Details, the sample withdrawal form, and the option to declare withdrawal online can be found under Right of withdrawal.

8. Warranty

The statutory warranty rights apply. For entrepreneurs, the limitation period for claims due to defects in newly manufactured goods is one year from the transfer of risk; statutory limitation periods for recourse claims remain unaffected. For consumers, the statutory time limits apply.

9. Dispute resolution

We are not willing or obliged to take part in dispute resolution proceedings before a consumer arbitration board.

10. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state of their habitual residence. If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is our registered office.
